Welcome to Jason Nappi Weather. These Terms of Use govern access to and use of JasonNappiWeather.com, the Jason Nappi Weather mobile app, public and premium forecasts, radar, alerts, videos, maps, email updates, sponsor content, forms, and related services.

By accessing or using these services, you agree to these Terms of Use and the Jason Nappi Weather Privacy Policy. If you do not agree, do not use the website, app, premium membership, or related services.

Weather Information and Safety

Jason Nappi Weather provides forecasts, radar, alerts, videos, maps, analysis, and related weather information for general informational purposes.

Weather conditions can change rapidly. Forecasts, radar displays, alerts, automated data, road-trip guidance, fishing forecasts, marine information, and other weather products may be delayed, incomplete, unavailable, or inaccurate. Forecasts describe expected conditions and are not guarantees.

Jason Nappi Weather does not issue official watches, warnings, advisories, evacuation orders, road closures, or emergency instructions. During hazardous weather, always follow information from the National Weather Service, National Hurricane Center, emergency management agencies, law enforcement, transportation officials, the United States Coast Guard, and other appropriate public-safety authorities.

Jason Nappi Weather is not a substitute for emergency communication, professional marine or aviation briefings, medical advice, road-closure information, or professional safety and operational decision-making.

Do not rely exclusively on Jason Nappi Weather for decisions involving personal safety, emergency planning, marine navigation, aviation, transportation, property protection, or other activities where inaccurate or delayed information could cause harm.

For an immediate emergency, call 911 and follow instructions from official public-safety authorities.

Acceptable Use of the Website and App

You may use Jason Nappi Weather for lawful personal and informational purposes.

You may not:

• Attempt to gain unauthorized access to an account, administrative area, server, database, or other restricted system
• Interfere with or disrupt the website, app, forms, radar, alerts, memberships, or connected services
• Bypass or attempt to defeat security controls, spam protection, payment requirements, membership restrictions, or access controls
• Share premium account credentials or allow multiple unrelated people to use one personal membership
• Copy, scrape, download, or extract Jason Nappi Weather’s original forecasts, articles, graphics, videos, or premium content at scale without written permission
• Repost or present Jason Nappi Weather content as an official government forecast, warning, watch, advisory, or emergency instruction
• Use the website, app, forms, or comments to distribute spam, malware, fraudulent messages, unlawful content, harassment, or abusive material
• Impersonate Jason Nappi Weather, Jason Nappi, another user, a government agency, or a public-safety authority
• Submit information you know is false, misleading, infringing, or unlawful
• Use the services in a way that violates another person’s intellectual-property, privacy, publicity, or other legal rights
• Reverse engineer, decompile, or attempt to extract protected source code except where applicable law specifically permits it
• Use automated systems in a way that creates unreasonable traffic, disrupts service, or degrades access for other users

Normal browser use, personal sharing through provided social-media controls, and standard search-engine indexing are not prohibited by this section.

You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. Notify hello@jasonnappi.com if you believe an account has been accessed without authorization.

Jason Nappi Weather may restrict or suspend access when reasonably necessary to protect users, content, systems, service providers, or legal rights, or when these Terms are materially violated.

Premium Memberships, Billing, Cancellation, and Refunds

Jason Nappi Weather offers an optional premium membership providing access to regional forecasts, marine forecasts, forecast videos, storm analysis, Nappi’s Notes, and other premium content.

The current membership price is displayed on the registration page. Unless otherwise stated at checkout, the membership is billed monthly and automatically renews through Stripe until canceled. By subscribing, you authorize Stripe to charge the selected payment method on each recurring billing date.

Members are responsible for maintaining accurate account and payment information. A failed or declined payment may result in suspension or loss of premium access.

You may cancel through the available account controls or by emailing hello@jasonnappi.com. To prevent another renewal, submit the cancellation request before the next scheduled billing date.

Cancellation stops future renewals. Unless otherwise stated or required by law, premium access continues through the end of the already-paid billing period.

Completed monthly charges are not prorated or refunded. Exceptions may be provided for duplicate charges, confirmed billing errors, or when required by applicable law. To report a billing problem, email hello@jasonnappi.com with the email address associated with the account, the charge date, and a description of the problem. Do not send complete payment-card information by email.

Membership pricing, features, and availability may change. When reasonably practical, notice of a price change will be provided before a new rate is charged to an existing subscription.

Premium content is licensed for the member’s personal, noncommercial use. It may not be copied, publicly reposted, shared through a common account, resold, redistributed, or used to create a competing product without written permission.

Forecast publishing schedules and premium features may occasionally be affected by severe-weather coverage, technical problems, provider outages, maintenance, or other circumstances beyond reasonable control.

Intellectual Property and Sharing

Jason Nappi Weather’s original forecasts, written analysis, articles, graphics, photographs, videos, audio, software, page designs, logos, branding, and other original materials are owned by Jason Nappi Weather or used with permission and are protected by applicable intellectual-property laws.

Official government data, alerts, maps, imagery, and other third-party materials remain subject to the ownership, public-domain status, licenses, terms, and attribution requirements of their original providers. Jason Nappi Weather does not claim ownership of National Weather Service, NOAA, or other government information merely because it is displayed or explained through the website or app.

Users receive a limited, revocable, nonexclusive, nontransferable license to access Jason Nappi Weather content for personal, noncommercial use.

Public content may be shared through provided social-media controls or direct links. Public forecast graphics may also be shared unchanged for personal, noncommercial purposes when Jason Nappi Weather branding and attribution remain clearly visible.

Without written permission, users may not:

• Remove or obscure logos, watermarks, source credits, copyright notices, or attribution
• Alter a forecast graphic or statement in a way that changes its meaning
• Present Jason Nappi Weather content as their own work
• Reproduce or republish complete articles, videos, graphics collections, or substantial portions of the website or app
• Use original content in advertising, paid products, commercial publications, competing services, automated datasets, or artificial-intelligence training datasets
• Sell, license, syndicate, or commercially distribute Jason Nappi Weather content
• Copy, repost, distribute, or publicly display premium content outside the subscriber’s personal account

The Jason Nappi Weather name, logos, character mark, slogans, and other brand identifiers may not be used in a way that implies endorsement, sponsorship, partnership, or official affiliation without written permission.

Third-Party Services, Links, and Sponsors

Jason Nappi Weather may display or link to information, tools, maps, radar, videos, app stores, government resources, local businesses, sponsors, and other services operated by third parties.

Third-party content and services may be unavailable, delayed, incomplete, inaccurate, or changed without notice. Jason Nappi Weather does not control and is not responsible for a third party’s content, availability, security, privacy practices, products, services, pricing, policies, or actions.

When users open an external link or embedded service, they may be subject to that provider’s own terms, privacy policy, cookie practices, and data-collection practices.

Links to the National Weather Service, NOAA, emergency agencies, transportation agencies, marine resources, app stores, radar providers, or other official and commercial services are provided for convenience and additional information. A link does not make Jason Nappi Weather an official government service or representative of the linked provider.

Jason Nappi Weather may feature paid sponsors, community partners, or promotional messages. Sponsored or paid relationships will be identified when reasonably required. Sponsors do not control Jason Nappi Weather’s forecast conclusions, warning communication, or editorial weather judgment.

Links to sponsors or local businesses do not guarantee or endorse a particular product, service, price, availability, safety practice, or customer experience. Business hours, menus, services, conditions, and other external information can change, so users should verify important details directly with the business or provider.

Jason Nappi Weather is not responsible for transactions, communications, disputes, injuries, losses, or other outcomes involving a third-party website, sponsor, business, product, or service.

Service Availability, Updates, and Notifications

Jason Nappi Weather works to provide reliable access but does not guarantee that the website, mobile app, premium content, radar, forecasts, alerts, videos, maps, forms, or other features will always be available, uninterrupted, current, secure, or error-free.

Service may be affected by:

• Internet, hosting, server, or network failures
• National Weather Service, NOAA, radar, mapping, video, payment, app-store, or other provider outages
• Scheduled or emergency maintenance
• Software defects, browser limitations, unsupported devices, or outdated app versions
• Severe-weather traffic and unusually high demand
• Security incidents or protective restrictions
• Events outside reasonable control

Some features require a compatible device, internet connection, browser settings, location permission, notification permission, or current app version. Users are responsible for device, internet, mobile-data, and carrier charges.

Jason Nappi Weather may add, modify, replace, pause, or discontinue features, content, membership benefits, data providers, or parts of the website or app. When reasonably practical, notice will be provided before a material change affecting an active paid membership.

App updates may be distributed through the Apple App Store, Google Play, or another authorized platform. Continued access to certain features may require installing an available update.

Push notifications, email updates, warning sounds, and in-app alerts are convenience features. Delivery may be delayed, duplicated, filtered, interrupted, or unavailable. These features must not be used as the sole source of official warnings or emergency information.

Temporary interruption, provider failure, maintenance, or delayed content does not automatically entitle a user to a refund. This does not limit any refund or remedy required by applicable law.

Disclaimer of Warranties

To the fullest extent permitted by law, Jason Nappi Weather and its services are provided on an “as is” and “as available” basis.

Jason Nappi Weather does not guarantee the accuracy, completeness, timeliness, availability, reliability, suitability, or uninterrupted delivery of forecasts, alerts, radar, maps, videos, road-trip guidance, fishing forecasts, marine information, premium content, notifications, or third-party data.

To the fullest extent permitted by law, Jason Nappi Weather disclaims warranties that may otherwise be implied, including warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation.

Nothing in these Terms excludes a warranty, right, or remedy that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by law, Jason Nappi Weather, its owner, contractors, partners, sponsors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of—or inability to use—the website, app, forecasts, alerts, radar, premium content, notifications, forms, or third-party services.

This includes losses or harm associated with:

• Weather changes or forecast uncertainty
• Delayed, missing, duplicated, or inaccurate alerts or notifications
• Decisions based on forecasts, radar, maps, road-trip guidance, fishing information, marine information, or other content
• Provider outages, maintenance, device problems, internet failures, or unsupported software
• Loss of data, account access, revenue, opportunity, business, travel time, or property
• Third-party websites, sponsors, products, services, transactions, or content
• Unauthorized access or security incidents despite reasonable safeguards

Users remain responsible for verifying important information through appropriate official, professional, and public-safety sources.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law and do not limit rights that cannot legally be waived.

Feedback, Messages, and User Submissions

Private contact, support, billing, account, and privacy messages are used to respond to the request, operate services, maintain appropriate records, prevent abuse, and comply with legal obligations. Submitting a private support message does not give Jason Nappi Weather permission to publish it for promotional purposes.

If a user voluntarily submits a suggestion, feature idea, correction, or general product feedback, Jason Nappi Weather may use that feedback to improve the website, app, forecasts, or services without an obligation to provide payment or compensation. Personally identifying information will not be included in a public attribution without permission.

Users may occasionally submit photographs, videos, storm reports, testimonials, comments, or other content specifically for possible publication. Unless separate written terms are provided, the user retains ownership of original submitted content but grants Jason Nappi Weather a nonexclusive, worldwide, royalty-free license to review, reproduce, edit for length or formatting, display, publish, and share that content in connection with weather coverage, the website, app, social media, and promotion of Jason Nappi Weather.

This license applies only to content intentionally submitted for possible publication—not ordinary private support, billing, account, or privacy messages.

By submitting content for publication, the user confirms that:

• The user created the content or has permission to submit it
• Publication will not violate another person’s copyright, privacy, publicity, or other rights
• The content is not knowingly false, deceptive, unlawful, defamatory, threatening, or harmful
• Any necessary permission has been obtained from identifiable people appearing in the content
• The content does not expose sensitive personal information or create an unreasonable safety risk

Jason Nappi Weather is not required to publish submitted content and may edit, decline, or remove it at any time.

Do not submit confidential information, passwords, complete payment-card information, medical records, private account credentials, or content that the user does not have permission to share.

Questions about a submission or requests concerning future use may be sent to hello@jasonnappi.com. Removal from future use may not be possible for materials already published, distributed, archived, or incorporated into completed content, subject to applicable law.

Privacy

The collection and use of personal information through Jason Nappi Weather is described in the Jason Nappi Weather Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference. If these Terms and the Privacy Policy conflict concerning the collection, use, sharing, retention, or protection of personal information, the Privacy Policy controls for that issue.

Changes to These Terms

Jason Nappi Weather may update these Terms when services, membership features, business practices, technology, or legal requirements change.

The date at the top of this page will be updated whenever these Terms are revised. When reasonably appropriate, notice of a material change may also be provided through the website, app, account system, or email.

Changes apply from the stated effective date. Continued use of the website, app, membership, or related services after updated Terms become effective constitutes acceptance of the revised Terms.

Changes to membership pricing are also subject to the notice provisions in the Premium Memberships, Billing, Cancellation, and Refunds section.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles.

Before starting a formal legal proceeding, users are encouraged to contact hello@jasonnappi.com and provide a reasonable opportunity to resolve the concern informally.

Any dispute that cannot be resolved informally will be handled by a court with appropriate jurisdiction in Florida, except where applicable consumer law permits or requires a claim to be brought elsewhere.

Nothing in these Terms prevents either party from bringing an eligible matter in small-claims court or seeking immediate relief when reasonably necessary to protect intellectual property, account security, confidential information, or personal safety.

General Terms

If any part of these Terms is found to be invalid or unenforceable, it will be limited or modified only as much as necessary, and the remaining provisions will remain in effect.

If Jason Nappi Weather does not immediately enforce a provision of these Terms, that does not waive the right to enforce it later.

These Terms, the Privacy Policy, and any applicable membership or checkout disclosures form the agreement between you and Jason Nappi Weather regarding the Services, unless a separate written agreement applies.

You may not transfer your account or your rights under these Terms without written permission. Jason Nappi Weather may transfer these Terms as part of a merger, reorganization, or sale or transfer of the business or its assets.

Section headings are provided for convenience and do not change the meaning of these Terms.
